These Terms of Service (“Terms”) govern all photography services provided by Cincinnati Event Photographers to the Client.

By booking services, the Client agrees to these Terms in full.

1. Services

Cincinnati Event Photographers provides professional event photography services, including corporate events, conferences, private events, and related assignments, as agreed upon in writing prior to the event date.

Coverage duration, deliverables, and scope of work will be outlined in the booking agreement or invoice.

2. Booking & Payment

A signed agreement and non-refundable retainer are required to secure the event date.

Remaining balances are due no later than the event date unless otherwise agreed in writing.

Failure to remit payment may result in delayed image delivery or withholding of usage rights.

3. Cancellation & Rescheduling

The retainer is non-refundable.

Rescheduling requests must be made in writing and are subject to availability.

Cancellations made within a specified timeframe (as outlined in the contract) may be subject to additional fees.

4. Copyright & Usage Rights

All images remain the copyrighted property of Cincinnati Event Photographers under U.S. Copyright Law.

The Client is granted a non-exclusive, non-transferable commercial license to use the delivered images for marketing, promotional, and internal business purposes unless otherwise stated in writing.

Images may not be sold, licensed, or distributed to third parties without prior written consent.

5. Image Integrity & Alteration

The Client agrees that the delivered images represent the Photographer’s professional work and artistic standard. The Client shall not alter, manipulate, edit, apply filters to, crop beyond minor size adjustments, overlay graphics, or otherwise modify the images in any way, including but not limited to social media filters (e.g., Instagram, Facebook, TikTok), color presets, or third-party editing tools, without prior written consent from Cincinnati Event Photographers.

Any unauthorized alteration shall be considered a material breach of this Agreement and an infringement of Cincinnati Event Photographers copyright. In such an event, the Cincinnati Event Photographers reserves the right to revoke the Client’s license to use the images and pursue all available legal remedies under Ohio and U.S. copyright law, including injunctive relief and damages.

6. Delivery & Archiving

Final edited images are typically delivered within an agreed timeframe.

Images are delivered digitally via download or online gallery.

Cincinnati Event Photographers are not responsible for long-term storage of images beyond 90 days after delivery.

7. Client Responsibilities

The Client agrees to:

Secure permission for photography at the venue.

Notify attendees of photography occurring at the event.

Obtain any required releases unless otherwise agreed.

Cincinnati Event Photographers is not responsible for missed images due to interference, venue restrictions, or event delays.

8. Limitation of Liability

In the unlikely event of total failure to perform due to circumstances beyond control (including illness, equipment failure, or acts of God), liability is limited to the return of payments received.

Cincinnati Event Photographers is not liable for indirect or consequential damages.

9. Independent Contractor

Cincinnati Event Photographers operates as an independent contractor and is not an employee of the Client. Cincinnati Event Photographers is responsible for all taxes, insurance, and business expenses.

10. Governing Law

These Terms shall be governed and interpreted according to the laws of the State of Ohio, without regard to conflict-of-law principles.

11. Acceptance of Terms

Booking photography services constitutes acceptance of these Terms of Service in full.
